Bankruptcy Myths & Misconceptions

Common Myths About Bankruptcy

Many people who are in debt believe that they have done something wrong. At the Law Office of Patrick J. Conklin, I tell our clients this is simply not true.

Bankruptcy is for honest people whose life circumstances have prevented them from effectively managing their debt. It is not designed to punish people; it is there to provide you with the means to make a fresh start.

Don't Believe Bankruptcy Myths

Our lawyers at the Law Office of Patrick J. Conklin hear many bankruptcy myths from our clients, friends and family. It is important to address these myths to put your mind at ease prior to filing for bankruptcy:

  • I will lose everything I own: Most people who go through bankruptcy keep most, if not all, of their possessions and property.
  • My credit score will be ruined forever: Bankruptcy will negatively affect your credit; however, the sooner you file, the sooner you can rebuild your credit score.
  • I will never be able to buy a house or new car: You are actually more likely to be approved for a home or car loan a short time after bankruptcy than when you were in debt.
  • I will lose custody of my child: If you are overwhelmed by debt, filing for bankruptcy is one of the more responsible things you can do for you and your family.
  • I can only file for bankruptcy once: You can only file for Chapter 7 once every eight years; in Chapter 13 reorganization, you can file more often, but you can only have one case open at a time.

Bankruptcy: The Stigma is Gone

Many clients who come to me seeking debt relief believe that there is a stigma attached to filing for bankruptcy. In my experience, this no longer exists. Don't let a stigma of the past prevent you from regaining control of your finances.
